Impeachment in the Philippines

Elpidio Quirino was accused in 1949 of using government funds to renovate Malacanang Palace in Manila, using government funds to purchase furniture for the Presidential Palace, and linking him to alleged diamond smuggling. A Congressional committee rejected his compliant for lack of factual and legal basis.

Diosdado Macapagal in 1964 was accused of illegally importing rice to build public support in an election, illegally dismissing officials, using the military to intimidate the political opposition, and ordering the deportation of an American businessman who was in the custody of Congress in violation of the separation of governmental powers. A Congressional committee dissed all the charges.

Ferdinand Marcos was accused by 56 lawmakers on 1985 of graft, economic plunder, unexplained wealth, granting monopolies too cronies, and other crimes. the following day the National Assembly committee dismisses the complaints after roughly five hour of discussions for continuing unsupported conclusions.

Corazon Aquino was accused by law makers in 1988 of graft and violating the Constitution. the charge were rejected the following month due to lack of evidence.

Joseph Estrada was accused of bribery, graft and corruption, betrayal of public trust, and culpable violation of the Constitution during the impeachment of 2000, to determine the accusations, the House of Representatives choose 11 members to act as prosecutors with the Senate as the impeachment court and the senators as judges

On November 13, 2000 Representative Manny Villar, then the speaker of the House of Representatives, sent the article of impeachment to the Senate of the Philippines for trial.

The impeachment trial started on December 7, 2000 and was aborted on January 16, 2001 after the House prosecutors walkedout from the impeachment proceedings, to protest against the perceived dictatorial tendency of the eleven senator-judges, who supported Joseph Estrada, this walkout led to EDSA Revolution of 2001 and the downfall of president Estrada.

Gloria Macapagal-Arroyo was accused in 2005, 2006, 2007 and 2008 impeachment complaints for different imputations, specially attempting lying, cheating and stealing during 2004 presidential election against opposition candidate Fernando Poe, Jr.. However all impeachment cases were failed due to absence of one third vote from the members of the Congress.

Manny Pacquiao opposes mining and illegal logging

Mining is good business. But it's terrible public policy. Congressman Manny Pacquiao's stance on this issue shows he's a public servant.

Once Congress resumes session, the eight-time boxing champion will deliver a privileged speech which will implore colleagues in the lower House to oppose mining and illegal logging operations in the country. The first-term congressman recently purchased 10-hectare and 2-hectare lots near his district to be distributed for free to victims of natural disasters such as typhoon "Sendong".

Congressman Manny Pacquiao reminded them of the destruction to the environment brought on by mining activities, according to a statement by his congressional office.

Mining operations have existed in the country for decades. It's a profitable venture given the rising global demand for minerals. For example, several dozen materials that go into a computer once came from a mining operation. For years, manufacturers in the United States have been facing rising steel prices due to shortages from Asian suppliers, and most pre-order whatever supply is available.

Mining is bad public policy because, over the long-term, income per capita and productivity are not increased. A vast majority of minerals are exported to other countries as raw materials for their industries. Over the long-term, the Philippine economy is almost always never improved.

Investors ship profits (investable capital) overseas to seek returns elsewhere. Thus, mining operations largely develop the economies of other countries, and not that of the host country.

Natural calamities, which kill hundreds, routinely occur due to soil depletion and/or instability. Public resources such as underground water and natural streams are permanently harmed. Additionally, damage to the ecosystem harms farmers who depend on agriculture for their livelihood.

The person/persons responsible for disseminating the video in the cyberspace can be held liable for violating Section 4 of Republic Act 9995, or the Anti-Photo and Video Voyeurism Act of 2009. The bill gained momentum at the height of the controversy regarding the sex videos of Hayden Kho with different women (Katrina Halili, Maricar Reyes, among others).

Section 4.d prohibits anyone from showing or exhibiting “the photo or video coverage or recordings of (sexual acts) or any similar activity through VCD/DVD, Internet, cellular phones, and other similar means or device.”

These prohibitions apply even if there is consent from the persons in the video. Curiously, the bill does not prohibit individuals from taking videos of themselves while having sex as long as it remains private (see Section 3.d and 4.a and b).

Technically, the mere uploading of this one-minute sex clip in websites is punishable by law. Street vendors who will sell this video can also be held liable. Violating RA 9995 carries a maximum penalty of 7-year imprisonment and a fine of P500, 000.

Any media outlet that airs this clip or publishes screen shots from the video can have their license to operate or franchise revoked. The law sounds strict, but it is almost impossible to implement thoroughly. Using the Ram Revilla-Janelle Manahan sex video, here are some questions I have in mind:

1. Where did this video come from (i.e. Ram’s laptop)? Who copied it from that source?
2. Who uploaded it to the Internet?
3. Who are those who reposted/re-uploaded the video in other websites?

Pinpointing the persons behind the aforementioned acts is a near-impossible task for our authorities. First, the Revilla clan seems not to be cooperative – even though they should feel violated because a murdered kin is involved in the video. Second, how are they going to find out the person who did the initial uploading of the video online? Third, how can they track the online users (all of them!) who reposted the video in other websites?

If a concrete case can emerge from the proliferation of the Ram Revilla-Janelle Manahan sex video, then it can be the first real test of the strength and worthiness of the Philippine Anti-Photo and Video Voyeurism Act.

Pantawid Pamilyang Pilipino Program (4Ps)

is a poverty reduction and social development strategy of the national government that provides conditional cash grants to extremely poor households to improve their health, nutrition and education particularly of children aged 0-14.

4Ps has dual objectives:

Social Assistance - to provide cash assistance to the poor to alleviate their immediate need (short term poverty alleviation); and
Social Development - to break the inter-generational poverty cycle through investments in human capital.

4Ps helps to fulfill the country’s commitment to meet the Millennium Development Goals, namely:

Eradicate Extreme Poverty and Hunger
Achieve Universal Primary Education
Promote Gender Equality
Reduce Child Mortality
Improve Maternal Health

Targeting System
The poorest households in the municipalities are selected through a Proxy-Means Test. This test determines the socio-economic category of the families by looking at certain proxy variables such as ownership of assets, type of housing, education of the household head, livelihood of the family and access to water and sanitation facilities.
Eligible Households

Residents of the poorest municipalities based on 2003 Small Area Estimates (SAE) of NSCB;
Households whose economic condition is equal to or below the provincial poverty threshold.
Households that have children 0-14 years old and/or have a pregnant woman at the time of assessment;
Households that agree to meet conditions specified in the program.

Set of Co-Responsibilities
To avail of the cash grants beneficiaries should comply with the following conditions:

Pregnant women must avail pre- and post-natal care and be attended during childbirth by a trained health professional;
Parents must attend responsible parenthood sessions, mother’s classes and parent effectiveness seminars;
0-5 year old children must receive regular preventive health check-ups and vaccines;
3-5 year old children must attend day care or pre-school classes at least 85% of the time.
6-14 year old children must enroll in elementary or high school and must attend at least 85% of the time.
6-14 years old children must receive deworming pills twice a year.

Program Coverage
4Ps operates in 45 provinces covering 255 municipalities and 15 key cities.
At present, 700,000 households are enrolled in the program and are receiving cash grants.
Program Cycle

The implementation of 4Ps Program follows the 8-step cycle starting from the 1) selection of target areas, 2) supply side assessment, 3) selection of household beneficiaries, 4) registration and validation of beneficiaries, 5) Family Registry preparation, 6) initial payment, 7) verification of compliance and 8) 2nd and succeeding release of cash grants.

Program Package
4Ps provides cash grants to the beneficiaries to wit:

P6,000 a year or P500 per month per household for health and nutrition expenses; and

P3000 for one school year or 10 months or P300/month per child for educational expenses. A maximum of three children per household is allowed.

A household with three qualified children receives a subsidy of P1,400/month during the school year or P15,000 annually as long as they comply with the conditionalities. The cash grants shall be received by the most responsible person in the household, usually the mother, through a Land Bank cash card.
In cases where payment through cash card is not feasible, the beneficiaries shall be provided their cash grants through an alternative payment scheme such as over-the-counter transactions from the nearest Landbank branch or offsite payments through Landbank.

Recently the terms “governance” and “good governance” are being increasingly used in development literature. Bad governance is being increasingly regarded as one of the root causes of all evil within our societies. Major donors and international financial institutions are increasingly basing their aid and loans on the condition that reforms that ensure “good governance” are undertaken.

This article tries to explain, as simply as possible, what “governance” and “good governance” means.

GOVERNANCE

The concept of “governance” is not new. It is as old as human civilization. Simply put “governance” means: the process of decision-making and the process by which decisions are implemented (or not implemented). Governance can be used in several contexts such as corporate governance, international governance, national governance and local governance.

Since governance is the process of decision-making and the process by which decisions are implemented, an analysis of governance focuses on the formal and informal actors involved in decision-making and implementing the decisions made and the formal and informal structures that have been set in place to arrive at and implement the decision.

Government is one of the actors in governance. Other actors involved in governance vary depending on the level of government that is under discussion. In rural areas, for example, other actors may include influential land lords, associations of peasant farmers, cooperatives, NGOs, research institutes, religious leaders, finance institutions political parties, the military etc. The situation in urban areas is much more complex. Figure 1 provides the interconnections between actors involved in urban governance. At the national level, in addition to the above actors, media, lobbyists, international donors, multi-national corporations, etc. may play a role in decision-making or in influencing the decision-making process.

All actors other than government and the military are grouped together as part of the “civil society.” In some countries in addition to the civil society, organized crime syndicates also influence decision-making, particularly in urban areas and at the national level.

Similarly formal government structures are one means by which decisions are arrived at and implemented. At the national level, informal decision-making structures, such as “kitchen cabinets” or informal advisors may exist. In urban areas, organized crime syndicates such as the “land Mafia” may influence decision-making. In some rural areas locally powerful families may make or influence decision-making. Such, informal decision-making is often the result of corrupt practices or leads to corrupt practices.

GOOD GOVERNANCE

Good governance has 8 major characteristics. It is participatory, consensus oriented, accountable, transparent, responsive, effective and efficient, equitable and inclusive and follows the rule of law. It assures that corruption is minimized, the views of minorities are taken into account and that the voices of the most vulnerable in society are heard in decision-making. It is also responsive to the present and future needs of society.

Participation

Participation by both men and women is a key cornerstone of good governance. Participation could be either direct or through legitimate intermediate institutions or representatives. It is important to point out that representative democracy does not necessarily mean that the concerns of the most vulnerable in society would be taken into consideration in decision making. Participation needs to be informed and organized. This means freedom of association and expression on the one hand and an organized civil society on the other hand.

Rule of law

Good governance requires fair legal frameworks that are enforced impartially. It also requires full protection of human rights, particularly those of minorities. Impartial enforcement of laws requires an independent judiciary and an impartial and incorruptible police force.

Transparency

Transparency means that decisions taken and their enforcement are done in a manner that follows rules and regulations. It also means that information is freely available and directly accessible to those who will be affected by such decisions and their enforcement. It also means that enough information is provided and that it is provided in easily understandable forms and media.

Responsiveness

Good governance requires that institutions and processes try to serve all stakeholders within a reasonable timeframe.

Consensus oriented

There are several actors and as many view points in a given society. Good governance requires mediation of the different interests in society to reach a broad consensus in society on what is in the best interest of the whole community and how this can be achieved. It also requires a broad and long-term perspective on what is needed for sustainable human development and how to achieve the goals of such development. This can only result from an understanding of the historical, cultural and social contexts of a given society or community.

Equity and inclusiveness

A society’s well being depends on ensuring that all its members feel that they have a stake in it and do not feel excluded from the mainstream of society. This requires all groups, but particularly the most vulnerable, have opportunities to improve or maintain their well being.

Effectiveness and efficiency

Good governance means that processes and institutions produce results that meet the needs of society while making the best use of resources at their disposal. The concept of efficiency in the context of good governance also covers the sustainable use of natural resources and the protection of the environment.

Accountability

Accountability is a key requirement of good governance. Not only governmental institutions but also the private sector and civil society organizations must be accountable to the public and to their institutional stakeholders. Who is accountable to whom varies depending on whether decisions or actions taken are internal or external to an organization or institution. In general an organization or an institution is accountable to those who will be affected by its decisions or actions. Accountability cannot be enforced without transparency and the rule of law.

CONCLUSION

From the above discussion it should be clear that good governance is an ideal which is difficult to achieve in its totality. Very few countries and societies have come close to achieving good governance in its totality. However, to ensure sustainable human development, actions must be taken to work towards this ideal with the aim of making it a reality.

There is exclusiveness even in death. It has been shared that in the Philippines, there are two types of people; rich and poor, rich people do not want to be with the poor ones.

Rev. Gaudario was talking to a lady about one of her family members had been recently buried. He asked where they buried the wake. She told him Holy Mary Memorial Park, which is an exclusive cemetery for the rich folks. It is located at Cutcut, Angeles City. So, priest said "Oh Yes, I know where that it is in Cutcut." She got a little testy, because there is also another cemetery for the poor folks, commonly known as Cutcut Cemetery. She replied "No! Holy Mary." He may have again tried to clarify by saying "Yes in Barangay Cutcut." but she would not be caught dead (argh) burying a relative there, so she said "No. Holy Mary!"

No matter where a wake would it be buried whether in a “museleo” or in a simple apartment, what important is his/her final destination; heaven or hell.

The cardinal reason for building a new community has something to do, in fact, with the characteristic of our age; the fundamental needs of the constituency; especially the poor. this is a necessity over which the might of government can be of no avail, for the poor, and marginalized are in many ways, the people for which government exist. The deficiencies of the past are primarily brought about by mis- education. therefore; with a new thrust of education in combining work, study and social involvement, the management of a reposeful community begins, in this crucial times, with the government, but it ends with the people. Introduce therefore reforms in an effort to correct the past deficiencies and broaden the base of participation by the population in the development process. Initiate economic reform that will contribute to create an environment more conducive to sustained economic growth.

RESOLUTION CREATING THE BARANGAY CUTCUT SCHOLARSHIP PROGRAM.

WHEREAS, this resolution aims to provide financial assistance to poor but deserving students who
want to pursue secondary education at any public school.

WHEREAS, One hundred (100) scholars/grantees shall be accommodated per school year

WHEREAS, the CUTCUT BARANGAY COUNCIL shall incorporate in the annual budget the funds to cover the implementation of this program.

WHEREAS, this program shall take effect beginning school year 2012-2013.

Resolution implementing Barangay ID System which will be the file maintenance system of the barangay to be used in keeping their records. The Barangay ID System will also be a census-like system of each resident of the barangay for each resident will now have an identification number containing their personal records. This is also based on the Memorandum Circular No. 2008-144 of the DILG issued last September 19, 2008.

WHEREAS, under the Local Government Code, barangays can compel all barangay residents within their jurisdiction to register.

WHEREAS, barangay residents shall have the option to apply for an ID card.

WHEREAS, a unique reference number (URN) will be assigned to each agency program member or registered barangay resident.

WHEREAS, Barangay Identification system will reduce the hard time procedure of accessing files and records they keep and store. The system will also be the census like system of the barangay for all of its constituents and new people who will live in the place. The system will be effective in maintaining, searching and storing of records of all resident in the barangay.

WHEREAS, The Barangay Identification system also benefits its residence for they will be accommodated easily for they will have an identification that can be used to access their accounts if there are some changes to be done in their part. It will also be easy for them in requesting some information and services because the barangay had already have it. This will also assure the residents that their information is properly secured and maintain through the manipulation of the proposed system.

NOW THEREFORE, on motion Barangay Kagawad ROY DANTE OGURIDA duly seconded by Barangay Kagawad JUANITO D. DAYRIT a resolution implementing Barangay ID System which will be the file maintenance system of the barangay to be used in keeping their records. The Barangay ID System will also be a census-like system of each resident of the barangay for each and every resident will now have an identification number containing their personal records hereby unanimously approved.

RESOLVED, that this Resolution once approved and executed shall be valid and effective after fifteen days.

RESOLVED FINALLY, that copies of this resolution be furnished the office of the Punong Barangay, all
barangay outpost and all government agencies concerned.

A Resolution requesting the Department of Social Welfare and Development – Angeles City, the City Council of Angeles and other government concerned to grant financial assistance each of the two (2) families who were affected by the fire last 27th of March 2011 chargeable to the 5% Calamity Funds.

WHEREAS, on the 27th day of March around 3:58 in the afternoon, a fire incident occurred in a residential house located at Rizal St., Ext., Cutcut, Angeles City.

WHEREAS, on the ocular inspection by the Bureau of Fire Protection appears, that there is no evidence gathered to proved that the said involved property was willfully, feloniously and intentionally set on fire.

NOW THEREFORE, on motion Barangay Kagawad ROY DANTE C. OGURIDA, duly seconded by Barangay Kagawad EMERENCIANA L. SIGUA in session assembled do hereby resolved as it hereby unanimously resolved approving this Resolution this 2nd day of April 2011 at Barangay Cutcut, Angeles City.

RESOLUTION No. 18 Series of 2011

A Resolution granting financial assistance amounting five thousand pesos (Php 5,000.00) each of the two (2) families who were affected by the fire which happened on the 27th of March 2011 and such amount is chargeable to the 5% Calamity Funds.

WHEREAS, on the 27th day of January around 3:58 o’clock in the afternoon, a fire incident occurred in a residential house located at #786 Rizal Extension, Barangay Cutcut, Angeles City.

WHEREAS, pursuant to the provisions of RA 8185, otherwise known as ‘An Act Amending Section 324 (d) of RA 7160, otherwise known as the Local Government Code of 1991’, (sic) its Implementing Rules and Regulations, and Executive Order No. 201 dated 26 April 2003, it is hereby clarified that the 5% local calamity fund of every local government unit (LGU) shall be utilized only for the relief, reconstruction, rehabilitation and other works and services, in connection with a calamity which occurred during the budget year. Under the aforesaid Act, calamity has been defined as a state of extreme distress or great misfortune caused by adverse event or natural force, causing widespread loss or extensive damage to livestocks, lives, crops and properties. Accordingly, any adverse event, such as but not limited to, acts of terrorism and spread of Severe Acute Respiratory Syndrome (SARS) or other endemics, that could fall within the ambit of the definition of calamity defined by law, can be a legal basis for LGUs concerned to declare their own state of calamity.

WHEREAS, the Fund valid for used on relief, rehabilitation, reconstruction and other works or services in connection with man-made disasters resulting from unlawful acts of insurgents, terrorists and other criminals, as well as for disaster preparedness and other pre-disaster activities.

NOW THEREFORE, on motion of Barangay Kagawad ROY DANTE OGURIDA, duly seconded by Barangay Kagawad EMERENCIANA SIGUA in a session assembled, do hereby approved the financial assistance amounting to five thousand pesos (Php 5,000.00) each of the two (2) families who were affected by the fire last 27th of March 2011 chargeable to the 5% Calamity Funds.

A RESOLUTION CREATING THE BARANGAY DEVELOPMENT COUNCIL

WHEREAS, Section 106 of the Local Government Code of 1991 mandates the LGU to organize a Local Government Council at the Province, city, municipal or barangay which shall assist the corresponding Sanggunian in setting the direction of economic and social development and coordinating development efforts within its territorial jurisdiction.

WHEREAS, the Barangay Development Council, pursuant to Section 107 of the same Code shall be headed by the Punong Barangay and shall be composed of members of the Sangguniang Barangay representatives of NGOs operating in the barangay who shall constitute not less than one forth (1/4) of the members of the fully organized council and a representative of the congressman;

Rules and Regulations of Basketball Tournament

I. ELIGIBILITY

a. To be eligible to participate in this tournament, a player must be a resident of the Purok he represent for no less than six (6) months prior to the opening date and duly certified by the Designated Kagawad.

b. He must not be a present member of any of country’s National Basketball Leagues (PBA, MBA, PBL).

c. AGE REQUIREMENTS

II. Team composition

a. Participating teams may have fifteen (15) players and all fifteen (15) players will be allowed to play in any game.

b. The official number of the players begins from number 1 following by 2, 3, and 4 up to the last number of players.

Ang Pabasa ay ang pag-awit o pagbasa ng mga deboto sa mahabang pasyon ni Hesukristo. Ang nasabing pasyon na nasa anyong patula ay hango sa Bibliya ng mga Katoliko Romano. Ang grupo ng mang-aawit ay kakanta nang sabay sa saliw ng luma o bagong kanta, sinasamahan ng mga instrumento kung minsan upang mas masigla ang pagbabasa. Kadalasan ang pabasa ay idinadaos kapilya ng barangay. Ang pagbasa ng pasyon ay sinisimulan sa Miyerkoles Santo at tinatapos sa Biyernes Santo.

Halos lahat ng mga tao sa isang komunidad ay nakikisali sa gawaing ito, maliban lamang sa iba na may ibang pananamaplataya. May mga may-ari ng imahen na nagpapahiram ng kanilang poon, mayroon din naman na nagbibigay ng pera at pagkain bilang kontribusyon. Karaniwang salabat ang inihahaing inumin dito upang mapaganda at hindi mapaos ang boses ng kalahaok sa pagbsa ng pasyon.

Dito sa atinng barangay ang mga babae at ilang lalaki ay ginagawa ang pabasa sa loob ng kapilaya ng baryo o kaya naman ay sa bahay ng may-ari na magpapabasa. Gumagawa sila ng pansamantalang altar at lalagyan ito ng Krus o mga imahen na nauugnay sa pasyon katulad ng Kristung Makagapus, Desmayadu o Dolorosa. Kadalasan ay ipinapatong ang mga ito sa ibabaw ng altar na may mga bulaklak at mga nakasinding kandila. Ang pabasa ay ginaganap isang beses sa lahat ng Linggo ng Kuwaresma.

Ang pasyon ay isang anyo ng sining. Ang unang bersyong Tagalog ay ang ginawa ni Gaspar Aquino de Belen, na may pamagat na Mahal na Pasion ni Jesu Christong Poon. Habang ang pinakatanyag ay ang Pasyong Genesis ni Mariano Pilapil (1814). A RESOLUTION CALLING ON THE SUPREME COURT TO STOP ILLEGAL CONVERSION OF MUNICIPALITIES TO CITIES, PROTECT THE LOCAL GOVERNMENT CODE, UPHOLD THE LAW AND RESPECT THE CONSTITUTION.

WHEREAS, after declaring the sixteen (16) cityhood laws unconstitutional in ruling issued on August 24, 2010, the Supreme Court reversed the said decision once again, and reinstated its December 21, 2009 ruling, which affirmed the constitutionality of the said laws.

Whereas, this is the third time that the Supreme Court has reversed itself on the issue of whatever or not the cityhood laws, which allow 16 municipalities to be converted into cities, is constitutional;

WHEREAS, the constitutional provision states that no province, city, municipality or Barangay shall be created, divided, merged, abolished or its boundary substantially altered, except in accordance with the criteria established in the Local Government Code and subject to approval by a majority of the votes cast in a plebiscite in the political units directed affected;

Whereas, the flip-flopping of the Supreme Court is unprecedented in its history and will set a bad precedent and will disturb the well-establish legal principles on finality and immutability of final judgments;

WHEREAS, this action of the Supreme Court does not inspire confidence in our judicial processes and is another setback in our quest to restore the people’s faith in our judicial system;

WHEREAS, the Supreme Court decision will only open the floodgates for more conversions of unqualified municipalities to become cities in violation of the express provisions of the Constitutional and the Local Government Code of 1991;

WHEREAS, the Supreme Court ruling shall only cause confusion and instability in the development and planning process of Philippine cities and will seriously and adversely affect the delivery of basic services;

WHEREAS, the Supreme Court decision will unduly reduce the income of Philippine Cities intended for anti-poverty, health, education and other equally significant programs aimed at improving the quality of their constituents;

WHEREAS, League of Cities of the Philippines (LCP) does not oppose the creation of cities per se; LCP is against the conversion of municipalities to cities which do not comply with the requirements under the Constitution and Republic Act No. 7160, as amended by Republic Act No. 9009;

WHEREAS, League of Cities of the Philippines (LCP has endorsed and supported the conversion of the cities of Biñan and Dasmariñas; and LCP is also ready to endorse the conversion of qualified municipalities including Bacoor, Imus, Cabuyao and other progressive municipalities who may determined as qualified for conversions;

NOW THEREFORE, the Cutcut Barangay Council on behalf of its constituents and residents, hereby resolves to;

1. URGE the Supreme Court to honor and uphold the mandates of the Constitution and the rule of law which is the basic foundation of our democratic system.

2. Urge the Supreme Court to RESPECT the well-establish legal principles on finality of judgment and preserve the stability of our judicial and legislative.

3. CALL on the Filipino people to safeguard the Supreme Court as the last bulwalk of democracy and the final arbiter of all judicial and constitutional issues.

4. CALL on the Filipino people to join the effort and advocacy to Stop the illegal Conversion of Cities Protect the Local Government Code, Uphold the rule and Respect the Constitution.

NOW THEREFORE, be it resolved as it is hereby resolved by the Cutcut Barangay Council in session assembled, that a resolution calling on the Supreme Court to stop illegal conversion of municipalities to cities, protect the local government code, uphold the law and respect the constitution.

A RESOLUTION REQUESTING HONORABLE FRANKLIN DRILON, SENATOR OF THE REPUBLIC OF THE PHILIPPINES TO ALLOCATE FUNDS FROM HIS COUNTRYSIDE DEVELOPMENT FUND FOR THE PROPOSED IMPROVEMENT OF CUTCUT BARANGAY HALL IN THE AMOUNT OF ONE MILLION EIGHT HUNDRED FIFTY ONE THOUSAND TWO HUNDRED NINETY NINE PESOS AND SEVENTY FOUR CENTAVOS (P 1,851,299.74).

WHEREAS, the improvement of Cutcut Barangay Hall is a priority concern of this Barangay;

WHEREAS, Barangay Cutcut having limited funds and income necessitate the allocation for the improvements of Cutcut Barangay Hall;

WHEREAS, its proposed improvement of Cutcut Barangay Hall will be more advantageous and convenient, management-wise, resulting in increased efficiency in operations and improved services to the public.

WHEREAS, this august body and the people of Barangay Cutcut look up to Honorable Senator Franklin Drilon for support towards the realization of this endeavor.

A RESOLUTION persuading the Honorable Barangay Chairman CECILIA C. NEPOMUCENO the non-issuance of Barangay Clearance and or Barangay Business Permit to Kennon Farms of Paradise, Cutcut, Angeles City.

WHEREAS, on the several occasions that the City Council ‘s Committee on Environment and Natural Resources had conducted an ocular inspection on Kennon Farm.

WHEREAS, upon the inspection, presence of maggots on the waste water drainage were visible, thus violating the RA 9275, known as Philippine Clear Water Act of 2004

WHEREAS, a very obnoxious odor emanating from the whole compound of Kennon Farm, most specially near the water treatment area, is also a violation of RA 8749 or Clean Air Act of 1999.

WHEREAS, pursuant to the said inspection and investigation Kennon Farm violate Environmental Laws.

NOW THEREFORE, on motion of Kagawad ROY DANTE C. OGURIDA duly seconded by Kagawad GINA T. NULUD;

San Roque Fiesta - August 15 & 16, 2010

Yearly fiesta in honor of San Roque. Unlike other parts of the country San Roque is celebrated here in Barangay Cutcut on every August 16. San Roque is the patron saint of the sick and the invalids.

San Roque was born around 1295 in a rich family in Montpellier, France. Tradition says that San Roque had a birthmark with a red cross on his chest.

His father died when he was 12 and his mother died when he was 20. He joined the Franciscan order soon after that and distributed his fortune among the poor.

San Roque then set out for Italy as a mendicant pilgrim and stopped along the way to care for the victims of the plague that was ravaging Italy at that time. He was reputed to have performed many miracles of healing everywhere he went.

On his return incognito to Montpellier he was arrested as a spy by order of his own uncle and thrown into prison, where he languished five years and died on 16 August 1327. Only when he was dead did the townspeople recognized him (by a birthmark). Soon, he was credited with continuing to work miracle cures against the pestilence, and he was soon canonized. Almost identical stories were related about numerous other saints.

According to some accounts the history of the feast of San Roque in the Philippines started in 1637. Residents of the town of San Roque came down from the mountains where they had contracted malaria. But they were miraculously cured after holding a procession in honour of San Roque. It is said that the procession was held in a fiesta atmosphere, with a lot of dancing and singing.

The President said the revolution against Spanish colonizers by our national heroes that include Andres Bonifacio nurtured this dream and gave birth to a sense of nationalism and a dream of a better life for Filipinos.

In 1963, the President said peasants also started to be emancipated from a feudal bondage from rich landlords when her father, the late President Diosdado Macapagal, worked hard for the promulgation of the Land Reform Law.

She said the implementation of these pro-poor programs were all achieved through economic reforms that resulted to a lower budget deficit, better economic growth and generated much needed funds to finance vital infrastructure projects such ports, seaports, airports, bridges, highway networks and the roll-on roll-off ferry system.

The President said the May 2010 automated elections also delivered the most modern and open election that will lastingly change the face of Philippine politics such as the earliest proclamation in history of the President and Vice President last Wednesday.

In the course of her speech, beneficiaries thanked the President for her numerous programs, including Grade 5 pupil Joan Duya of Porac, Pampanga who said she no longer has to walk two hours to school after the President directed the establishment of a classroom in her barangay. The President said it was the 100,000th classroom built under her term.

Julia Baco of Gutalac, Zamboanga del Norte, who was able to send her three children to school, were among the one million poor families who benefited from the successful implementation of the Pantawid Pamilyang Pilipino Program (4Ps), one of the President’s flagship programs on poverty reduction and social development.

Matson Paskial of Dupax del Norte, Nueva Vizcaya, a construction worker for the Bitong-Belance Nueva Vizcaya Road, said he saw residents of other nearby towns send their farm produce to the nearest market because of the new roads.

Russel Brian Dizon, a 22-year-old jobless nurse who gained a training scholarship has found employment in the business process outsourcing (BPO) industry which the President said has become a $7-billion industry providing 500,000 high-paying jobs.

Alan Amanse, a former fisherman earning only P100 per day, is now a whale shark interactor in the flourishing tourism industry in Sorsogon.

ANGELES CITY – Basketball stars Arwin Santos, Ranidel de Ocampo and Mark Yee leads the Panings team to victory of the 1^st Mayor Francis “Blueboy” Nepomuceno Invitational Basketball Tournament defeating Roels during the championship game held at Cutcut People’s Gym, Cutcut, Angeles City on March 6.

Team Manoks Fried managed to place second runner-up while team Shasyly had to console themselves as fourth place in the competition.

Team Paning brought home the plum prize of P70,000, while Roel’s received P40,000 for its daring play. Team Manoks Fried got P15,000 and Shasyly obtained the P5,000.

Individual awards went to Panings cagers which include Mark Yee as the Most Valuable Player (MVP), Tim Dungca got the Best Forward and Ambet Gumabon as the Best Coach. While in team Roels Melvin Bangal and Billy Bansil ruled in the Best Guard and Best Center respectively.

I. ELIGIBILITY

b. He must not be a present member of any of country’s National Basketball Leagues (PBA, MBA, PBL). Former or current school varsitarians may join the competition if given permission by the school he is a player at.

III. Uniforms

a. No Team/Player shall be allowed to play without wearing the proper uniform (identical).

b. The official number of the players begins from number 1 following by 2, 3, and 4 up to the last number of players.

IV. Duties and responsibility

a. Both coaches of the playing team should know the rules and regulations of the game and must see to it that they are in total control of their players and their benches.

b. Only the coaches of the playing team are allowed to stand and make necessary verifications/complaints during the progress of the game.

V. Team discipline and conduct of players

a. A team must be present at the playing court fifteen (15) minutes before the scheduled match. In case a team will not show up after a grace period of fifteen (15) minutes given will lose by forfeiture

b. Any team who commits two (2) consecutive game defaults will be withdrawn from the tournament without prior notice.

c. Any player, coach or manager who commits any of the enumerated acts of violence or un-sportsman-like conduct shall be penalized with a technical foul and or a suspension in the game depending upon the gravity of the violation/situation.

d. Players who are under the influents of liquor or any prohibited substance are not allowed to play.

VI. Game stop procedure

a. If a game is stopped due to unavoidable circumstances like power failure, bad weather condition and render the court is not unplayable.

i. If the match is in progress is stopped in the 1^st or 2^nd period, the game shall be reset to a new game with another playing date. The score will be back to zero and the time will be reset.

ii. In the game was stopped in the 3^rd, 4^th or overtime period, the game will be resumed to another playing date adopting the score and the remaining time of the game when it was stopped.

VII. Breaking of ties

a. In case of double tie “WIN OVER OTHER” system shall be used to break the tie, there will be no play-off

b. In case of triple tie or multiple ties, the goal average or quotient system shall be used to break the tie; there will be no play-off.

VIII. Protest procedure

a. All protest concerning the eligibility of the players shall be done in written form and be submitted to the technical committee within forty-eight (48) hours (office hours) before or after the game. NO-PROTEST AFTER ELIMINATION ROUND

IX. Supplemental rules

a. The committee officials’ and referees’ decision is final.

b. The 2000-2001 FIBA Rules and Regulations shall govern this tournament.

X. Impersonation

a. Any player who is found out using other’s identity shall be suspended and automatically be blacklisted in any basketball competition as sanctioned by the Cutcut Barangay Council, and all the game/s he played by the team he represents shall be declared lost and the team shall be automatically out from the league.

C. Senior Division:

- After the elimination round the No.1 meet the No.4 team for semi-final. Knock-out system however if the No.1 team has no lose record shall beat twice of the No. 4 team. How To Find Online Your Precinct Before Election Day

As part of the Commission on Election's (Comelec) continuing registration program, it has made a way for you to find your precinct online. The data they have is based on Comelec’s Field Data officer’s submissions. It is a good time to verify now where your precinct is, so you could act upon it.

Here’s how. Fire up your favorite web browser (mine, by the way, is Safari 4), and then go visit Comelec’s website.

You will find yourself looking at this:

Simply fill up the form - enter your first name, middle name and last name, and date of birth in the appropriate spaces. And then click "Find Now" then your done!

Tips for Using PRECINCT FINDER:

        1. Fill in all NAME fields completely as you indicated in your Application Form for registration.
        2. Do not type just your MIDDLE INITIAL if you indicated your complete MIDDLE NAME during registration.
        3. In case encoding errors may have been committed by your local COMELEC office:

                a. If your name contains a JR, SR, II, III, IV, etc., try several variations of typing your name, as follows:

in the FIRST NAME field after your first name, such as JUAN JR.
in the LAST NAME field after your last name, such as DELA CRUZ JR.
with a period, such as JR.
without a period, such as JR
with a comma and period, Such as JUAN, JR. or JUAN JR.,
with two (or three) spaces in between, such as JUAN JR. or JUAN JR.

I was invited to attend the Bagong Botante event last November 13 together with other bloggers. This was an event I was itching to go to because I wanted to see with my own eyes the counting machine and the ballot to be used in the coming 2010 elections. Yes, I had a lot of questions.

COMELEC and Smartmatic people came out in full force. Among those in the crowd were COMELEC spokesperson James Jimenez, Cesar Flores (President, Smartmatic-Asia Pacific Region), Rafael Cuenca (Smartmatic Voter Education Website Coordinator), Gene Gregorio (Smartmatic Spokesman & PR Manager) and Miguel Avila (also with Smartmatic).

If you’re one of those voting for the first time and you're wondering whether voting is going to be complicated, or if you have some skepticism about the ballot’s being secure, I’ll let you in on some of the things I learned about the ballot that night.

What the Ballot Looks Like

The ballot is still in paper form just like the old ballot we are used to. But it now looks more professional and is roughly the size of an A4 sheet of paper. The names of the candidates running for national positions are printed back-to-back. Here is a sample of the ballot.

How To Fill out the Ballot

It’s a lot easier to fill out the ballot now because there is no need to write names. All we have to do is shade the oval beside our candidate of choice.

We also do not need to bring pencils or ballpens. COMELEC-provided markers will be available at the precincts.

To vote, just shade the oval completely right beside the name of your selected candidate. It’s just like coloring the oval. Simple.

Important Do’s and Don’ts

There are a few things to remember so as not to invalidate your vote and to minimize inconveniences to you.

Shade the oval completely. Marking it with a dot, X, a line or any other mark is NOT VALID. Partial shading also may risk invalidation as it won’t be properly read by the machine.
Do not OVERVOTE. This means you should NOT vote more candidates than available positions. For example, there should be only ONE Presidential vote. If you shaded 2 or more names, your vote for President is invalidated. (Note: only the section with overvoting is invalidated. The other parts of your ballot remain valid as long as you shaded the right number of candidate names for the position).
You can UNDERVOTE. This means you can vote for LESS candidates than available positions. For example, if you need to choose 12 senators but you only opt to vote for 10, that is allowed.
It is better to go to the precinct with your list of chosen candidates already (codigo). This will speed up the time it will take for you to fill up your ballot and reduce chances of mistakes.

Casting Your Vote

You will cast your own vote. It’s simple. Just hold the ballot in your hand and feed it into the machine vertically. Just imagine that it’s just like inserting an ATM card into the machine or feeding paper into a fax machine.

It does not matter whether you feed it in top first or bottom first. Or back on top, or front on top. However way you put it in, the counting machine takes a snapshot of both the top and bottom sides so you are sure your ballot has a captured image (front and back).

Security Features of the Ballot

This was one area I was concerned about so it was interesting to discover that:

Position identifiers on the left and right sides of the ballot help locate the ovals for proper counting and evaluation.

Each ballot has a unique bar code. Once the machine reads a ballot’s bar code, any attempt to insert a duplicate ballot with the same code will be rejected.

Each ballot is marked with UV ink which is not readily discernible. The counting machine looks first for this mark before it counts a vote. This dispels the possibility of photocopied ballots which obviously won’t have the UV ink mark.
The ballot contains security markings (i.e., watermarks).

As of now, while many of my questions about the counting machine and ballots were answered at the event, I am still uneasy about the adequacy of the remaining time left before the May elections for everything to be put in place.

Finding enough IT personnel to man ALL the precincts, training the teachers on the operational procedures, delivering the machines/ballots/indelible ink/markers/etc to all the precincts in time – all these are just some of the things still in my head.

I am hoping though that these will be satisfactorily answered in the coming weeks so that we are all reassured that come election day, there will be no snafus like the confusion and inefficiencies that many people experienced during the recent voter registration.

How to vote in an Automated Election

Know the Automated Election Machine and the Source Code.
New and old voters might be a little intimidated by the fancy technology used for the 2010 Presidential elections. However, the new automated process is being employed for quick, easy, and transparent counting that should minimize fraud. Hopefully, this quick guide on how to vote in an automated election will make the procedure less confusing for you. Before reading the rest of the article, take time to know your ballot and Know the Automated Election Machine and How to find online your precint before election day.
Step 1- Go to your precinct on May 10
There will be about 37,062 voting centers and 74,427 clustered precincts. Each clustered precinct will have one Precinct Count Optical Scan (PCOS) machine, each of which can supposedly accommodate up to 1,000 voters. Read on How to find online your precint before election day.
Upon arriving at the precinct, a voter should look for his or her name at the Posted Computerized Voters List (PCVL) near the door of the voting center to determine his or her precinct number and sequence number. The voter will be instructed to give these pieces of information to the Bureau of Election Inspector (BEI) together with other personal information.
Make sure you bring your voter’s ID with you. If you don’t have one yet, bring any valid ID along with your registration stub.

STEP 2- Get your identity verified
After his or her identity is verified, the name of the voter will be read out loud to give chance for any contention. If uncontested, he or she will be given a ballot by the BEI chairman – only upon ensuring that the said voter has yet to cast his or her vote in another precinct.

STEP 3- How to use your ballot
Take a look on how the ballot looks like first..

Listen to the BEI's instruction on how to fill the ballot. The voter will be instructed to fill out his or her ballot using a secrecy folder and a marking pen provided by the Comelec. He or she must fill out the ballot by fully shading at least 50 percent of the oval beside the names of the candidates and party-list group of his or her choice. View sample ballot

Every voter gets only ONE ballot. No replacement ballots will be given to voters who make a mistake.
Make sure the ballot you receive has no marks and is otherwise clean.
Each ballot comes with the name of the candidates. To the left of the candidates are ovals. Simply shade the oval next to the name of the chosen candidate.
The oval must be shaded COMPLETELY. Ballots with check marks, x marks, partially shaded ovals, and other marks will be regected.
Do not over-vote (e.g. vote two candidates for the position of President) because this will invalidate your votes for the position (but not the whole ballot).
You can bring a sheet of your chosen candidates with you when you vote.

Comelec devised a way to make the ballots easier to read (see sample above)
The ballot will be divided into sections that will be delineated by a colored border. The sections will be colored blue for president, vice president, congressmen, provincial governor, and councilors; and green for senators, party-list groups, provincial board members, and municipal mayors.
STEP 4- Feed your ballot to the PCOS
Get to Know the Automated Election Machine
PCOS stands for Precinct Count Optical Scan. This is a paper-based technology that contains pre-programmed information on the location, number of voters, etc. Each precinct will have one PCOS. Voters themselves feed their ballot into the machine. The machine will scan both sides of the ballot and will reject invalid ballots that are fake, photocopied, or have been previously inserted.
Once you have accomplished your ballot, feed the ballot into the PCOS. Every voter must personally feed his or her ballot into the machine. Wait for the confirmation message to appear on the screen.
Wait until the ballot is dropped into the semi-transparent ballot box. If the ballot is rejected, the BEI will allow for another re-entry, but if rejected again, the voter will not be issued a replacement ballot.
the voter should return the secrecy folder and marking pen to the BEI chairman.
STEP 5 Go to the BEI for indelible inking
The BEI chairman will in turn apply indelible ink at the base and extend it to the cuticle of the right forefinger nail of the voter, who will then be instructed to affix his or her thumbmark in the space in the Election Day Computerized Voters List (EDCVL).
Just familiarize yourself with the steps and by viewing the video so you have an idea on how the process is like.
Help keep Philippine Elections clean
Philippine elections are characterized by vote-buying, intimidation, coercion, and terrorism. With many voters casting ballots with illegible handwriting and a procedure with weak security, it's easy to tamper election results and commit fraud. Hopefully the new automated system will eliminate all of these. It also helps if voters remain vigilant, cooperative, and coordinated during Election Day. Vote wisely. Choose your candidate based on coherent platform, character and competency.

Few Filipinos know little of automated polls

Even as 61 percent of Filipinos know little about the automated election system, almost half (49 percent) believe that there will be much trouble in the country if the May 10, 2010 elections will not push through, according to an independent survey.

These are two of the conclusions of a nationwide survey conducted by Pulse Asia between October 22 and 30 among 1,800 respondents with a margin of error of plus or minus 2 percent.

Despite this ignorance of the new way of voting, 40 percent think that automating the counting of the votes will result in clean elections with credible results. Only 16 percent believe otherwise. The rest (43 percent) are undecided about the effects of poll automation.

At the same time, it said: “The prevailing sentiment among Filipinos is that it is highly likely that the May 2010 polls will be held as scheduled [67 percent].”

The same survey concluded that 64 percent of Filipinos believe that the country’s public school teachers will perform their duties as members of the board of election inspectors, with 65 percent believing that the same teachers are capable of managing the automated polls this year.

Globe Tattoo Hack

Here’s an update for the Globe Tattoo Hack or might as well we can call it a Globe Tattoo Tweak since it deals with tweaking your Globe Tattoo USB Stick to perform at its utmost performance.
Here is what I do to tweak and/or hack my Globe tattoo.

Insert you Globe Tattoo to your PC / Laptop and let the Globe Tattoo Interface initiate. Once initiated, make sure that your Globe Tattoo is not connected yet, and then go to Tools then choose Options.

Once your inside the Options window, choose Profile Management and choose “New” and you’ll get to the window below.
Under the Profile Name, you can opt to choose any kind of name you want for that connection.
Under the APN box, choose the Static Option and enter http.globe.com.ph on the APN Field
Under the Authentication Box put *99***1# on the access number box. There is no need to input anything on the username and password fields.

after setting everything up, click the advanced button and change the DNS Settings to “static” type your preferred DNS in the fields. Click here for a list of Globe DNS values applicable for Globe Internet.

After that, click Ok and then click Save on the right panel. Also don’t forget to set it as default. Once you go back to the Globe Tattoo interface, the new Globe Tattoo Network Profile would now be available on the dropdown menu.

You can now choose it and use it when connecting your Globe Tattoo to the internet. I named mine Special DNS like the one below.

So that’s it, that is how my Globe Tattoo Hack Tweak, if you know any other tweaks then you can share using the comment feild below.

The Sangguniang Kabataan (Sk)

The Sangguniang Kabataan or SK (Youth Council) is the governing body in every chapter of the Katipunan ng Kabataan (Youth Federation). Each barangay in the Philippines is mandated by law to have its own chapter of the Katipunan ng Kabataan in which the members elect their officers called as the Sangguniang Kabataan. The Sangguniang Kabataan is an off-shoot of the KB or the Kabataang Barangay (Village Youth) which was abolished when the Local Government Code of 1991 was enacted.

The Sangguniang Kabataan is the youth legislature in every local village or community. It also initiates policies, programs and projects for the development of youth in their respective political territories. The Chairman of the Sangguniang Kabataan acts as the Chief Executive of the Sanggunian (Council) while the Kagawad (Councilor) as the legislative council. The Kagawads approve resolutions of the Sanggunian and appropriates the money allotted to the council, a share in the revenue of the Barangay.

The Chairman automatically sits in the Sanggunian Barangay (Village Council) as ex-officio member. He automatically gets chairmanship of the Committee on Youth and Sports, one of the standing committees in the village council. Every Sangguniang Kabataan is then federated into municipal and city federations, then city and municipal federations are federated into a provincial federation.

The barangay SK Chairman represents the barangay in the municipal or city federation. The presidents of the city and municipal federation presidents becomes member of the provincial federation and the provincial federation president becomes member of the national federation. The presidents of highly urbanized and independent component cities completes the membership in the national federation. The entire membership in the Federation elect the national federation president who automatically sits in the National Youth Commission as ex-officio member.

The national federation is governed by the National Executive Board while the municipal, city to provincial federation is governed by the Local Executive Committee composed mostly of the seven regularly elected officers of the federation.

Since 1992 up to the present, there have been three simultaneous nationwide SK elections held in the Philippines which each term lasting from a minimum of three to five years due to amendment of the regular 3-year term limit of the council. After every poll, election of federation officers follows. The elected presidents in the municipal and city federations sit as ex-officio member in the municipal or city council respectively while the provincial president represent the youth in the provincial board. All of these ex-officio members automatically chair the council's committee on youth and sports development.

What is Barangay?

The barangay is the basic political unit in the Philippines. It serves as the primary planning and implementing unit of government policies, plans, programs, projects, and activities in the community, and as a forum wherein the collective views of the people may be expressed, crystallized and considered, and where disputes may be amicably settled.

A barangay may be created out of a contiguous territory which has a population of at least 2,000, except in cities and municipalities within Metro Manila and other metropolitan political subdivisions or in highly urbanized cities where such territory shall have a certified population of at least 5,000. To enhance the delivery of basic services in the indigenous cultural communities, Congress may create a barangay in these communities.

Every barangay has a punong barangay, seven Sangguniang Barangay members, the Sangguniang Kabataan chairperson, a barangay secretary, and a barangay treasurer.

The Sangguniang Barangay, the legislative body of the barangay, is composed of the punong barangay as presiding officer, and the seven regular Sangguniang Barangay members elected at large and Sangguniang Kabataan chairperson as members.

A barangay also has a Lupong Tagapamayapa, which consists of 10 to 20 members and exercises administrative supervision over conciliation panels to effect speedy resolution of disputes.

Who may be elected punong barangay or member of the sangguniang barangay?

A citizen of the Philippines
At least 18 years old on election day
A registered voter and a resident for at least one year immediately before election in the barangay where he or she is running
Able to read and write Filipino or any other local language or dialect

What happens if a permanent vacancy occurs in the office of the punong barangay?

The highest ranking sangguniang barangay member or, in case of his or her permanent inability, becomes the punong barangay.
A tie between or among the highest ranking sanggunian members will be resolved by the drawing of lots.
The successor will serve the unexpired term of his or her predecessor.

What a punong barangay can do

Enforce all laws and ordinances applicable within the barangay
Negotiate, enter into, and sign contracts for and in behalf of the Barangay, upon authorization of the Sangguniang Barangay
Maintain public order in the barangay and assist the city or municipal mayor and the sanggunian members in the performance of their duties and functions
Call and preside over the sessions of the Sangguniang Barangay and the Barangay assembly, and vote only to break a tie
Upon approval by a majority of all the members of the Sangguniang Barangay, appoint or replace the barangay treasurer, the barangay secretary, and other appointive barangay officials
Organize and lead an emergency group whenever the same may be necessary for the maintenance of peace and order or on occasions of emergency or calamity within the Barangay
In coordination with the Barangay development council, prepare the annual executive and supplemental budgets of the barangay
Approve vouchers relating to the disbursement of barangay funds
Enforce laws and regulations relating to pollution control and protection of the environment
Administer the operation of the Katarungang Pambarangay
Exercise general supervision over the activities of the Sangguniang Kabataan
Ensure the delivery of basic services
Conduct an annual palarong barangay which will feature traditional sports and disciplines included in national and international games, in coordination with the Department of Education
Promote the general welfare of the barangay
Possess and carry the necessary firearm within his territorial jurisdiction, subject to appropriate rules and regulations

What the Sangguniang Barangay can do

Enact ordinances necessary to discharge the responsibilities conferred upon it by law or ordinance and to promote the general welfare of inhabitants
Enact tax and revenue ordinances, subject to the limitations imposed in the Local Government Code
Enact annual and supplemental budgets
Provide for the construction and maintenance of barangay facilities and other public works projects chargeable to the general fund of the barangay or such other funds actually available for the purpose
Submit to the Sangguniang Panlungsod or Sangguniang Bayan such suggestions or recommendations as it may see fit for the improvement of the barangay or for the welfare of its inhabitants
Assist in the establishment, organization, and promotion of cooperative enterprises that will improve the economic condition and well-being of residents
Regulate the use of multipurpose halls, multipurpose pavements, grain or copra dryers, patios and other post-harvest facilities, barangay waterworks, barangay markets, parking areas or other similar facilities constructed with government funds within the jurisdiction of the barangay and charge reasonable fees for their use
Solicit or accept monies, materials, and voluntary labor for specific public works and cooperative enterprises of the barangay from residents, land owners, producers, and merchants in the Barangay, provided that monies or properties donated by private agencies and individuals for specific purposes shall accrue to the barangay as trust fund
Provide compensation, reasonable allowances, or per diems as well as travel expenses for Sangguniang Barangay members and other Barangay officials, subject to budgetary and other limitations
Hold fund-raising activities for barangay projects without the need of securing permits from any national or local office or agency, but not within a period of 60 days immediately preceding and after a national or local election, recall, referendum, or plebiscite
Authorize the punong barangay to enter into contracts on behalf of the barangay
Authorize the barangay treasurer to make direct purchases in an amount not exceeding P1,000 at any one time for the ordinary and essential administrative needs of the barangay
Prescribe fines in amounts not exceeding P1,000 for violation of barangay ordinances

What disputes can be brought to the Lupong Tagapamayapa for amicable settlement?
The Lupong Tagapamayapa of each barangay has authority to bring together the parties actually residing in the same city or municipality for amicable settlement of all disputes except:

Where one party is the government, or any subdivision or instrumentality thereof
Where one party is a public officer or employee, and the dispute relates to the performance of his official functions
Offenses punishable by imprisonment exceeding one year or a fine exceeding P5,000
Offenses where there is no private offended party
Where the dispute involves real properties located in different cities or municipalities unless the parties thereto agree to submit their differences to amicable settlement by an appropriate lupon
Disputes involving parties who actually reside in barangays of different cities or municipalities, except where such barangay units adjoin each other and the parties thereto agree to submit their differences to amicable settlement by an appropriate lupon

Sangguniang Kabataan
The Sangguniang Kabataan is composed of a chairperson, seven members, a secretary, and a treasurer.

Who may be elected to the Sangguniang Kabataan?

A citizen of the Philippines
At least 15 years but not more than 21 years of age on election day
A qualified voter of the katipunan ng kabataan (The katipunan ng kabataan is composed of all citizens of the Philippines actually residing in a barangay for at least six months, who are 15 but not more than 21 years of age, and who are duly registered in the list of the Sangguniang Kabataan or in the official barangay list in the custody of the barangay secretary)
A resident of the barangay for at least one year immediately before election
" Able to read and write Filipino, English, or the local dialect

What happens if a permanent vacancy occurs in the Sangguniang Kabataan?

A Sangguniang Kabataan official who, during his or her term of office, passes the age of 21 years is allowed to serve the remaining portion of the term for which he or she was elected.
In case a Sangguniang Kabataan chairperson refuses to assume office, fails to qualify, is convicted of a felony, voluntarily resigns, dies, is permanently incapacitated, is removed from office, or has been absent without leave for more than three consecutive months, the Sangguniang Kabataan member who obtained the next highest number of votes in the election immediately preceding will assume the office of the chairperson for the unexpired portion of the term. Where two or more Sangguniang Kabataan members obtained the same next highest number of votes, the other Sangguniang Kabataan members will conduct an election to choose the successor to the chairperson from among the said members.
After the vacancy has been filled, the Sangguniang Kabataan chairperson will call a special election to complete the membership of said sanggunian. Such Sangguniang Kabataan member will hold office for the unexpired portion of the term of the vacant seat.

What the Sangguniang Kabataan can do

Promulgate resolutions necessary to carry out the objectives of the youth in the barangay
Initiate programs designed to enhance the social, political, economic, cultural, intellectual, moral, spiritual, and physical development of the members
Hold fund-raising activities, the proceeds of which shall be tax-exempt and shall accrue to the general fund of the Sangguniang Kabataan
Create such bodies or committees as it may deem necessary to effectively carry out its programs and activities
Consult and coordinate with all youth organizations in the barangay for policy formulation and program implementation
Coordinate with the appropriate national agency for the implementation of youth development projects and programs at the national level
